A party requesting that a record be filed under seal must file a motion or an application for an order sealing the record. The motion or application must be accompanied by a memorandum and a declaration containing facts sufficient to justify the sealing.

Filing of Documents Under Seal. A document authorized to be filed under seal by an existing court order shall be filed on paper accompanied by the court order authorizing it to be filed under seal and submitted in a sealed envelope marked with the case number, case caption and the words “sealed document.”

(c) The lettering or typeface shall be clearly legible and shall not be smaller than 14 point word processing font or, if typewritten, shall not be smaller than pica. The text must be double-spaced, but quotations more than two lines long may be indented and single-spaced. Headings and footnotes may be single-spaced.

If the presiding judge permits electronic filing and the case is public, you may file your motion for leave to file under seal using the Sealed and/or Ex Parte Motion event in ECF. This event will restrict the motion and the proposed sealed document, which you must attach as an exhibit to the motion, from public view.

The complaint must be filed with a magisterial district court that has venue over the claim. Venue is the geographic location where either a defendant can be served or where the cause of action occurred. Landlord / tenant complaints are filed where the property is located.
