Body-gripping traps are illegal in Washington, but certain of these traps may be authorized through the issuance of a Special Trapping Permit (STP; see definition). Cage and box traps, suitcase-type live beaver traps, and common rat and mouse traps are not classified as body-gripping traps and do not require a STP.

Although it is technically legal to trap moles and gophers there is no effective trap allowed for that use in Washington. All mole and gopher traps are body-gripping traps and were outlawed by the passage of Initiative-713. The use of any of these traps is a gross misdemeanor.

It is unlawful to trap for wild animals: With body-gripping traps EXCEPT by permit to abate an animal problem under WAC 220-417-040. These include, but are not limited to, padded foot-hold traps, unpadded foot-hold traps, all snares, and conibear-type traps.

Illegal trap: It is unlawful to trap wild animals with body gripping traps except with a special trapping permit to abate an animal problem. These traps include but are not limited to: Conibear, coilspring, longspring, snares, and jump traps.

In the State of Washington, it is unlawful to possess or transport live wildlife or wild birds (except starlings and house sparrows by falconers) without a permit (WAC 220-450-030). This includes Eastern gray squirrels, Eastern cottontail rabbits, raccoons, and opossums.

Legal Status With the passing of Initiative 713, given their body-gripping design, traditionally used mole traps are no longer legal for use in Washington (RCW 77.15. 192, 77.15.

(1) It is unlawful to use or authorize the use of any steel-jawed leghold trap, neck snare, or other body-gripping trap to capture any mammal for recreation or commerce in fur.
