There are 3 types of Form 5500: Form 5500-EZ—for one-participant plans only; Form 5500-SF for plans with fewer than 100 participants; and Form 5500—for plans with 100 or more participants. Forms 5500 and 5500-SF must be filed electronically using the DOL ERISA Filing Acceptance System (EFAST2)Opens in a new window.
Failure to file Form 5500 maximum penalty increases from $2,586 to $2,670 per day that the filing is late. Failure to furnish information requested by the DOL penalty increases from $184 per day, not to exceed $1,846 per request, to $190 per day, not to exceed $1,906 per request.
Beginning January 1, 2021, a "one-participant" plan and a foreign plan can file Form 5500-EZ electronically using the EFAST2 filing system or file Form 5500-EZ on paper with the IRS. You can no longer use Form 5500-SF in place of Form 5500-EZ.
Form 5500-SF: Small plans (those with fewer than 100 participants as of the beginning of the plan year) Form 5500: Large plans (those with 100 or more participants as of the beginning of the plan year) Form 5500-EZ: "One-participant" plan (owners/partners and their spouses)
Due date: the last day of the seventh month after the plan year ends (July 31 for a calendar year plan). See Increased penalties for failure to file retirement plan returns.
Employers who sponsor one-participant plans or foreign plans must file Form 5500-EZ electronically using the Department of Labor's EFAST2 filing system.
The IRS penalty for late filing of a 5500-series return is $250 a day, up to a maximum penalty of $150,000 per plan year.
The new methodology involves counting the number of participants with account balances on the first day of the plan year. ing to Form 5500, a plan is generally considered large if it has at least 100 participants with active accounts, triggering the requirement for an audit.
Further, penalties for small plans (generally under 100 participants) are capped at $750 for a single late Form 5500 and $1,500 for multiple years per plan. Penalties for large plans (generally 100 employees and over) are capped at $2,000 for a single late Form 5500 and $4,000 for multiple years per plan.
Under EFAST2, you must electronically file the 2023 Forms 5500 and 5500-SF using EFAST2's web-based filing system or you may file through an EFAST2-approved vendor. The 2023 Form 5500-EZ can also be electronically filed using the EFAST2 filing system or filed on paper with the IRS.
