FAQ

(1) A motion for continuance, extension, or waiver of the time standards provided by law and found in this rule must be in writing and signed by the requesting party. On a showing of good cause, the court must allow a motion for continuance or extension to be made orally at any time during the proceedings.

Most cases in Housing Court are settled, meaning the parties come to an agreement, usually called a "Stipulation of Settlement," which is written down and signed by the parties and the Judge. When you sign a Stipulation of Settlement, you are making a binding legal agreement that must be followed.

This Stipulation to Extend Time (NY) is a standard form that attorneys can use to extend most deadlines in a civil action in New York Supreme Court. The stipulation extends the applicable deadline on consent without prior permission from the court.

The parties may stipulate without leave of court to one 15-day extension beyond the 30-day time period prescribed for the response after service of the initial complaint. The court, on its own motion or on the application of a party, may extend or otherwise modify the times provided in (b)-(d).

If all parties agree to your extension request, you should prepare a stipulation containing all the terms of your agreement, including the new date, any other dates adjusted by the new deadline, and a description of the reasons for needing the extension. Counsel for all parties should promptly sign the stipulation.

This often requires the claiming party to give a particular notice, sometimes followed by a further notice and/or more detailed information, to the other party and/or contract administrator, which may have to be in a particular format and meet specific requirements as to content.

A Motion for Extension of Time in a Divorce is intended to help you avoid a default judgment against you. A Motion for Extension of Time in Florida family law can also be helpful when you have a discovery request due and the other side might otherwise file a motion to compel against you.

➢ Reasonable continuances may be granted, as necessary, for: • investigation; • discovery; • procuring counsel or witnesses.

Your request via email and/or letter will need to include the original filing dates, new proposed filing dates, the number of previous requests (if any), and whether the other party consents to the extension. Email a copy of the letter you file to the other party (usually it's an attorney).
