Some do so within a few weeks, while others take much longer. If the arbitration process goes to conclusion without settlement, a case takes an average of 11 months to complete. Of course, some cases take less than this while more difficult ones may take longer.

A petition to vacate or correct the award must be served and filed no later than 100 days after it is served.

In ICSID proceedings, a request for arbitration can be unilaterally withdrawn only before its registration. Once registered, the request for arbitration can no longer be withdrawn and a claimant seeking to withdraw from the proceedings will need to seek the “discontinuance” of the proceedings.

Some contracts give you the right to opt out of the forced arbitration clause within a certain period of time, often 30 to 60 days, after signing the agreement by notifying the company that you wish to opt out. Check your contract for the deadline and for specific instructions for opting out.

Interestingly, however, the time limits within which such motions may be filed, differ under the Federal Arbitration Act (FAA). Motions to confirm must be filed within a year after the award is made, whereas motions to vacate, must be filed within three months. See 9 U.S.C. Sections 9 and 12.

The attendance of witnesses at arbitration hearings may be compelled through the issuance of subpoenas as provided in the Code of Civil Procedure, in section 1985 and elsewhere in part 4, title 3, chapters 2 and 3.

Once parties enter into an arbitration agreement, they are generally bound by its terms, including the commitment to resolve their dispute through the arbitration process. However, there are limited circumstances under which you might exit the arbitration or change the arbitrator.
