ASan Diego Municipal Code §98.0730: Termination of Tenancy: A residential tenancy of more than two years duration shall not be terminated, nor shall its renewal be refused, except for one or more of the following reasons: (a) Nonpayment of Rent. expiration of a specified term, except as provided insection 98.0730(e);
If your tenant won't fix the problem or move out, you'll have to go through the court to get an order for them to move out. The eviction process can take 30 - 45 days, or longer. The time starts from when you have eviction court forms delivered to your tenant to the time they must move out.
Duration of the lease: Clearly state the term or duration of the lease. This could be a specific length of time (such as one year) or structured as a month-to-month agreement. In California, if the lease agreement is for more than one year, it must be in writing to be legally enforceable.
Code § 1947.12 restricts your landlord from increasing your rent more than 5% + the local rate of inflation or 10% (whichever is less) in a twelve month- period.
A lease is a binding contract between the landlord and the tenant once it has been signed. Changes by either party could have a negative impact. If both parties agree that changes are needed, an addendum could be added that would be signed by the landlord and the tenant.
California passed a new landlord-tenant law that will provide additional protections for renters around just cause evictions. The law took effect on April 1, 2024, and requires landlords to have just cause to terminate tenancy after a California tenant has been placed in the unit for 12 months.
