FAQ

Georgia has no quantitative restrictions (quotas) on trade (except on ozone depleting substances). Only medical products, firearms, explosives, radioactive substances, dual use goods, industrial waste, and a few types of agricultural chemical products are subject to import/export licensing.

O.C.G.A. Sections 10-1-390 et seq. ) Georgia's Fair Business Practices Act prohibits unfair and deceptive acts or practices in the marketplace. This law applies to consumer transactions involving the sale, lease or rental of goods, services or property mainly for personal, family or household purposes.

The phrase unfair trade practices can be defined as any business practice or act that is deceptive, fraudulent, or causes injury to a consumer. These practices can include acts that are deemed unlawful, such as those that violate a consumer protection law.

Trade restrictions include: Tariffs: Taxes collected by the government on imported goods. Quotas: Limits on the amount of imports allowed for each period. Voluntary Export Restraints: Limits on the amount of a good that can be exported, self-imposed by the exporting country.

- Under the Georgia Trade Secrets Act, O.C.G.A. § 10-1-760 et seq., a claim for misappropriation of trade secrets requires a plaintiff to prove that: (1) the plaintiff had a trade secret; and (2) the opposing party misappropriated the trade secret.

Most states require companies using an assumed name to register, however, 13 states (Alabama, Alaska, Arizona, Delaware, Florida, Hawaii, Kansas, Maryland, Mississippi, Nebraska, Ohio, Wisconsin, and Wyoming) do not have a state filing requirement.

California DBAs must be filed at the county level, unlike many other states where DBAs are filed with the state. You can start using a DBA before registering it, but you must file a fictitious name statement with your country clerk within 40 days to continue using the name legally.

It can be a good idea to obtain trademark protection for a trade name that is also used to identify your goods or services by filing an application to register the mark with the United States Patent and Trademark Protection Office (USPTO).

It does require that every person, firm or partnership doing any trade or business in Georgia, under any name which does not disclose the individual ownership of the trade or business, to file a registration statement in the office of the Clerk of Superior Court before commencing to do business.

Used mostly for branding purposes, a DBA is not a business structure and will not provide liability protection. A DBA must be registered with the county in which the business is located.
