The Due Process Clause provides that no states shall deprive any "person" of "life, liberty or property" without due process of law. There are very strong arguments that the debt ceiling violates the Fourteenth Amendment.First, the threat of federal debt repudiation at the time of the ratification of the Fourteenth Amendment was particularized and well defined. The treasury secretary warned of possible "calamity" unless Congress acts. The direct approach would be to declare the debt ceiling unconstitutional because the 14th amendment says that the public debt shouldn't be questioned. We must look to see if the interest is within the Fourteenth Amendment's protection of liberty and property. Congress establishes the limit on borrowing, and it's up to Congress to adjust it. In general, Texas has very few official legal forms. This is why you will not always find a free fill-in-the-blank form for your situation.
