On December 30, 2022, New York State Governor Kathy Hochul signed into law the “Foreclosure Abuse Prevention Act” (“Act”). The Act became effective immediately and applies to any foreclosure action in New York that was pending as of December 30, 2022 or filed thereafter.

If you file an Answer and appear at the mandatory settlement conference, it is taking lenders 1 to 3 years to foreclose.
In fact most Responses to complaints are formal pleadings. You can go to the clerk of the court and examine files that have answers in them if you wish to see the format. If you send a letter, simply explain to the court what you are requesting from the bank in order to try to keep your home.

File and send an Answer The first step for you after receiving the summons and complaint is to file an Answer with the court and to send the Answer to the law firm that is representing the lender. If the lawsuit is given to you by personal service, you have 20 days from the date of delivery to file and send an Answer.
The new law does not disturb New York's six-year statute of limitations on mortgage foreclosure actions. It simply restores a common-sense principle: no party may unilaterally stop and restart the statute of limitations to revive what would otherwise be a time-barred action.

In NYS the law mandates that after a foreclosure sale a Ten (10) day Notice to Quit must be served and a certified copy of the deed must be exhibited to the occupants/tenants of the premises. In addition, the law requires the service of a Ninety(90) Day Notice upon a bone fide tenant of the premises.
New York is a judicial foreclosure state, which means that the lender has to sue the borrower in order to enforce their rights under the mortgage and note. If the lender wins the lawsuit, it obtains a judgment from the court, which allows the lender to sell the property at an auction.
