FAQ

(c) A defendant shall file a verified answer within 30 days after the service of the summons and complaint. If service is made by publication and personal service has not been made, a defendant shall file such answer within 30 days of the date of final publication.

Typically, a plaintiff verifies a complaint by attaching a page at the end containing a statement made under oath that: The plaintiff has reviewed the complaint. The plaintiff knows or believes that all allegations that the plaintiff has personal knowledge of to be true.

A pleading must be in writing and must be signed by all persons joining in it. All pleadings filed in proceedings under the Probate Code must be verified. If two or more persons join in a pleading, it may be verified by any of them.

Unless a rule or statute specifically states otherwise, a pleading need not be verified or accompanied by an affidavit.

SECTION 446 When the complaint is verified, the answer shall be verified.

Proof of service shall specify the papers served, the person who was served and the date, time, address, or, in the event there is no address, place and manner of service, and set forth facts showing that the service was made by an authorized person and in an authorized manner.

The Verified Complaint is the document your spouse and your spouse's lawyer have written up to give to the court to explain why he or she should be given a divorce from you. In New York State, because of the way the laws are written, you must have “grounds” in order to get divorced.

Personal Service of Process in NY The most common way of effecting service upon a “natural person” is by hand delivery. Section 308 of the consolidated statutes (CPLR 308) states that personal service upon a person can be made “by delivering the summons within the state to the person to be served.” It's that simple.

You can either answer the summons in writing or in person. If you answer in person, you must go to the courthouse clerk's office and tell the clerk about your defenses to the plaintiff's claims. The clerk will check off the boxes in a Consumer Credit Transaction Answer In Person form.

If proof of service of the summons has not been filed within 60 days of the complaint's filing, the court may dismiss the action without prejudice.
