Utah Noneconomic damages, also known as general damages, are damages that cannot be easily quantified in monetary terms. These damages, which are paid to compensate a plaintiff for pain and suffering, emotional distress, and loss of consortium, are determined by the court on a case-by-case basis. Loss of consortium is a type of Utah Noneconomic damages that is awarded to compensate a plaintiff for the loss of a spouse’s companionship, affection, and sexual relations. Specifically, in Utah, there are two types of damages for loss of consortium: loss of society and loss of conjugal fellowship. Loss of society refers to the loss of companionship and affection, while loss of conjugal fellowship refers to the loss of sexual relations.
