2.61 INTERSTATE TRANSPORTATION OF OBSCENE MATERIAL FOR SALE OR DISTRIBUTION / 18 U.S.C. Sec. 1465 is a federal law that makes it a crime to knowingly transport obscene material in interstate or foreign commerce for the purpose of sale or distribution. Under this law, it is illegal to knowingly ship, transport, receive, possess, or distribute any obscene material, including any obscene book, magazine, periodical, film, videotape, or other material that has been determined by a court to be obscene. This law applies to all forms of obscene material, including materials that are intended for minors. There are two types of offenses under this law: (1) transporting obscene material for sale or distribution, and (2) possessing or distributing obscene material with the intent to sell or distribute it. Violation of this law is punishable by a fine and/or up to 5 years in prison.
