FAQ

Buying a car in person from a dealershipA vehicle order signed on the dealer's premises has no cooling-off period. Once you sign it, you are legally committed to everything shown on the form. In other words, you've bought a car.

The Federal Trade Commission's cooling-off period gives you three days to back out of a sale listed under the rule. However, this does not apply to every car sale, and does not apply to car loans. The cooling-off rule applies to: Sales made at your home, workplace, or dormitory.

The vast majority of car dealers have no written policies that allow you to rescind the purchase agreement you've signed. This means your only recourse is to plead your case. You can say that you have discovered you don't like the car or that it will stretch your budget and put you in dire financial straits.

If You Just Left a DepositCall the dealership and ask to talk to your salesperson. If the salesperson is not available, talk to the dealer's sales manager. Tell the dealer representative that you changed your mind about the vehicle and do not intend to purchase it. Ask to have your deposit refunded.

Because of how car valuation works, there is not a cooling-off period required as part of a car buying contract. If you signed your name on the dotted line for a new vehicle, it will be very difficult to return it or cancel it in most cases.

Any licensed dealer must offer the buyer of a used car (that costs $40,000 or less) the option to purchase a 2-day cancellation before signing the contract. If you purchase the option, you have the right to cancel the sale within two days for any reason.

One of the most common questions asked by consumers is whether there is a "Cooling-off" period under California law. Virtually every car sale contract in California includes fine print that allows a dealer to demand return of the vehicle within 10 days.

If you've purchased a new or used car and you're having second thoughts about it, in most cases, you won't be able to return the car. The dealer who sold you the car is usually not legally obligated to take the car back and issue you a refund or exchange after you've signed the sales contract.

Whether you have rushed into your agreement or you've found a better deal elsewhere, you should be able to cancel your car finance agreement for up to 14 days after you signed on the dotted line. This two-week period is known as a 'cooling off period'.
