A West Virginia Notice of Appearance — AO 458 is a document filed by a party in a West Virginia court proceeding to be present in a court hearing. This document must be filed with the court clerk prior to the hearing date. It must include the name of the party filing the Notice, the case number, the hearing date and time, and the court in which the hearing is to take place. There are two types of West Virginia Notice of Appearance — AO 458: an Appearance for an Individual and an Appearance for an Attorney. The Appearance for an Individual must be signed by the person appearing in the court and must be notarized. The Appearance for an Attorney must be signed by the attorney of record for the party and must include a certification that the attorney is authorized to appear on behalf of the party in the court proceeding.
