FAQ

The Shared Leave Program allows an employee to donate sick and/or vacation leave to another qualified employee who is out of leave (or nearly out of leave) and experiencing (or caring for a family member who is experiencing) an extreme, or life threatening illness or injury.

If employees continue to donate leave after 2020, employees should be treated as receiving taxable wages for the value of the leave, although the amount of the donated leave may be deductible by the employee as a charitable contribution (and is deductible as compensation by the employer).

The Voluntary Leave Transfer Program (Leave Share) allows federal employees to donate annual leave to other federal employees (excluding the leave donor's immediate supervisor) who are experiencing a medical emergency and have exhausted their available paid leave.

Utah Sick Leave and Protected Leave Although Utah does not have any mandatory sick leave laws, employers who have promised employees paid sick leave are under legal obligation to provide sick leave. Under FMLA, employees with serious illness can take up to 12 weeks of protected leave in a 12 month period.

Does sick pay reset every calendar year? In many locations that require employers to provide paid sick leave, employees can carry sick leave accrued in one calendar year into the next year. However, the maximum number of paid sick hours an employee can take per year will remain unchanged.

Many companies offer leave benefits that allow employees to take time off from work for various reasons. Leave benefits whether paid, unpaid or partially paid are generally an agreement between the employer and employee, or employees representative (such as a union).

An employer-sponsored leave-sharing program allows an employee to donate accrued hours of paid vacation, or personal and potentially sick leave for the benefit of other employees who are in need of taking more leave than they have available.

Utah Sick Leave: What you need to knowThere is no Utah law requiring private employers to grant their employees sick leave, paid or unpaid, although many employers do provide it and find that it is a popular employee benefit.

Full-time employees receive an average of 11 sick days their first year, increasing to 12 days after that initial year. Part-time government employees receive an average of 9 sick days every year. Full-time employees can accrue up to an average of 137 sick days where their policy permits carrying over time.

The FMLA gives eligible employees in Utah the right to take up to 12 weeks off work per year for pregnancy or parenting leave. The FMLA applies only to employers with at least 50 employees. If you qualify, you can use the FMLA to take time off when you are unable to work because of your pregnancy and childbirth.
