Reckless Burning-Utah Code Ann. Sec. 76-6-104(c) is the legal term used for the offense of intentionally or recklessly setting fire to any property, such as buildings, land, forests, or other structures, without the consent of the owner. This offense is a third-degree felony and carries a maximum penalty of five years in prison and a fine of up to $5,000. There are three types of Reckless Burning-Utah Code Ann. Sec. 76-6-104(c): Class A, Class B, and Class C. Class A Reckless Burning involves intentionally setting fire to any property or structure; Class B Reckless Burning involves recklessly setting fire to any property or structure; and Class C Reckless Burning involves setting fire to a building, land, or other structure with reckless disregard for the safety of others.
