It is the responsibility of the party making a claim to provide the necessary evidence to support that claim. There are two types of 1.27 Burden of Proof: the burden of persuasion and the burden of production. The burden of persuasion is the responsibility of the party making the claim to prove it by a preponderance of the evidence, or beyond a reasonable doubt. The burden of production is the responsibility of the party to present sufficient evidence to make a prima facie case of their claim.
