The Act defines an “enterprise” as any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not necessarily a legal entity. The Act states that any person who has a financial interest in an enterprise which has been found to be operating in violation of certain federal statutes shall be held liable for the profits which have been derived from such activity. The types of interests in the enterprise that are covered under this section of the law are: 1. An ownership interest; 2. A control interest; 3. A managerial interest; 4. An employment interest; 5. An investment interest; and 6. Any other interest which is not de minimis. The Act further states that any person who is convicted of having a financial interest in an enterprise in violation of certain federal statutes shall be subject to criminal penalties, including imprisonment, fines, and forfeiture of the profits obtained from such enterprise. Furthermore, any person who is found to have been involved in the activities of a racketeer influenced and corrupt organization shall be subject to forfeiture of any interest in the enterprise or any property derived from the enterprise.
