A Notice of Removal to Federal Court is a document filed by a defendant in a state court case to move the case to the federal court system. The defendant must provide a copy of the Notice to the plaintiff, the state court, and the United States District Court. There are two main types of Notice of Removal to Federal Court: voluntary and involuntary. Voluntary Notice of Removal is filed when both parties agree to move the case to federal court. Involuntary Notice of Removal is filed when only one party agrees to move the case to federal court. The Notice must include the names of all parties involved, the state court case number, the reason for removal, and the jurisdiction of the federal court. The Notice must also be signed by the defendant or their attorney.
