Under the Fair Housing Act, a landlord can't deny an emotional support animal and cannot charge additional rent or other pet fees to the owner of an ESA. Housing providers in Texas are subject to the Texas Fair Housing Act.
Is my landlord allowed to charge fees for my assistance animal? No. It is unlawful for landlords to (1) charge additional rent, (2) demand a pet deposit, or (3) charge any fees whatsoever for an assistance animal. The Fair Housing Act guarantees this protection.
An assistance animal is NOT a pet. Housing providers may NOT charge fees, deposits, or require pet insurance for assistance animals like they would with pets. Housing providers may NOT disallow an assistance animal because of its breed or size.
It's not required by law to register an ESA in Texas. ESA registries are usually done online and offer to ?register your ESA? in a nationally recognized registry or database, and typically ask for a high fee. There are no locally or nationally acknowledged databases for ESAs.
Summary: The California Department of Housing and Community Development requires each housing development to authorize a resident of the housing development to own or maintain one or more common household pets within a resident's dwelling unit.
