Under California law, a lease does have to be in writing to be enforceable, but only when the lease is for a period of more than a year.There is, however, an additional legal doctrine called partial performance which does make oral contracts enforceable even if they are covered by the Statute of Frauds.

Name the parties. A simple rental agreement form needs to name the parties signing the lease and where they live. Describe the premises. Define the term of the lease. Set how much rent is owed. Assign a security deposit amount. Finalize the lease.

Write the introduction. Describe the transaction and timeframes. List contingencies. Go through due diligence. Include covenants and other binding agreements. State that the agreement is nonbinding. Include a closing date.

The Letter of Intent should include the names of the parties negotiating, such as the name of the Tenant and the Property Owner/Landlord, and a list of industry standard list items. You should also include items that are important to your business when leasing commercial real estate.

As long as the contract spells out specific details and both parties have signed that they agree to the contract's terms, a handwritten contract is legally binding and enforceable in court.

An LOI is a short written document signed by the landlord and tenant, which describes the basic terms of the lease. By signing an LOI, the landlord and tenant can make sure they agree to fundamental lease terms before taking the time and incurring the expense of preparing and negotiating a lease.

What should you write on a rental application letter? It's quite simple: Write a few short paragraphs about who you are, what you do for a living and perhaps the reason for your move. If you're applying as a group for a property you intend to share, briefly introduce each housemate.
