Tennessee Order to Turn Over Funds (TOTO) is a court order issued by the Tennessee state court that requires a third party (typically a bank or other financial institution) to turn over money or other assets from an account held by the defendant to the plaintiff. There are two types of TOTO: prejudgment and post-judgment. Prejudgment orders are issued prior to the resolution of a lawsuit and are intended to preserve the status quo while the case is pending, while post-judgment orders are issued after the case has been decided in favor of the plaintiff and are intended to collect the money or assets awarded to the plaintiff in the judgment. Both types of orders can be used to collect funds from a variety of sources, including savings and checking accounts, investments, and real estate.
