32-23-2. Punishment for prohibited driving--First offense. If conviction for a violation of § 32-23-1 is for a first offense, the person is guilty of a Class 1 misdemeanor, and the court shall revoke the person's driver license for not less than thirty days.

(2) Class 2 misdemeanor: thirty days imprisonment in a county jail or five hundred dollars fine, or both.

Lastly, charges and convictions for Class 2 misdemeanors are automatically removed from a defendant's public record after five years have passed with no intervening convictions.

32-26-6. Lane driving required--Changing lanes--Violation as misdemeanor. On a roadway divided into lanes, a vehicle shall be driven as nearly as practicable entirely within a single lane and may not be moved from such lane until the driver has first ascertained that such movement can be made with safety.
