The South Carolina Affidavit for Collection of Personal Property Pursuant to Small Estate Proceeding is a legal form used in the state of South Carolina to transfer ownership of a deceased person’s personal property to a designated heir. This form is used when the estate is less than $25,000 and the deceased did not have a will or the estate is not subject to probate. This form allows the heir to take possession of the property without having to go through the lengthy and expensive probate process. There are two types of South Carolina Affidavit for Collection of Personal Property Pursuant to Small Estate Proceeding. The first type is an Affidavit of Collection of Personal Property Without Administration which is used when the deceased did not have a will or the estate is not subject to probate. The second type is an Affidavit of Collection of Personal Property With Administration which is used when the deceased had a will or the estate is subject to probate. In both cases, the affidavit must be witnessed by two people and notarized by a notary public. The affine (the heir) must provide proof of eligibility to receive the property and provide proof of death of the deceased.
