South Carolina Possession of Stolen Firearm is a felony offense. It occurs when an individual knowingly and unlawfully possesses a stolen firearm, or recklessly permits another person to do so. There are two distinct types of South Carolina Possession of Stolen Firearm: first degree and second degree. First degree South Carolina Possession of Stolen Firearm is a more serious offense. It occurs when an individual knowingly and unlawfully possesses a stolen firearm that has been used in a violent crime, such as a murder, rape, or robbery. It is punishable by up to 10 years in prison and/or a fine of up to $5,000. Second degree South Carolina Possession of Stolen Firearm is a less serious offense. It occurs when an individual knowingly and unlawfully possesses a stolen firearm that has not been used in a violent crime. It is punishable by up to 5 years in prison and/or a fine of up to $2,500. Both offenses require that the firearm was stolen prior to the possession in order for the charge to be valid.
