South Carolina Seditious Conspiracy is a criminal offense under South Carolina Code § 16-17-510. It occurs when two or more people plan to overthrow or oppose the state government, or to oppose the authority of public officials, through unlawful means. The law also makes it illegal to incite or assist anyone to carry out such a plan. This offense is punishable by up to five years in prison and a fine of up to $5,000. There are two types of South Carolina Seditious Conspiracy: direct seditious conspiracy and aiding and abetting seditious conspiracy. Direct seditious conspiracy is when two or more people directly plan to overthrow or oppose the state government, or to oppose the authority of public officials, through unlawful means. Aiding and abetting seditious conspiracy is when one person aids or abets another person in committing the offense of seditious conspiracy.
