A Rhode Island Complaint For a Protective Order When Either Party Is A Juvenile is a legal document that is filed with the Family Court in the state of Rhode Island. This document can be used to protect a minor from abuse, neglect, or exploitation. It is also used to prevent contact between a minor and another individual who is believed to pose a threat. The Complaint can seek a restraining order or other relief such as the transfer of custody of the minor, the placement of the minor in a safe environment, and/or other protective measures. There are two types of Complaints for Protective Orders when either party is a juvenile: a Civil Complaint and a Criminal Complaint. The Civil Complaint is filed in Family Court and is used for situations where a minor needs protection from abuse or neglect. The Criminal Complaint is filed in Superior Court and is used for situations where a minor needs protection from exploitation or a criminal act. Both Complaints are filed by the minor’s parent or guardian or by a state-appointed attorney or guardian ad item. The Complaint must include the names of the minor, the minor’s parent or guardian, and the individual or party from whom protection is sought. In addition, it must include specific information about the circumstances of the case, such as any history of abuse, neglect, or exploitation. Once the Complaint is filed, a judge will review the case and determine whether to grant a Protective Order.
