A New York Affidavit in Support of Motion to Vacate a Default Judgment by Defendant (Civil Cases) is a sworn statement used by a defendant in a civil case to challenge the court's ruling in favor of the plaintiff. The affidavit is generally used when a defendant failed to appear in court or failed to properly respond to the plaintiff's complaint. The affidavit allows a defendant to present new evidence or legal arguments to the court in an effort to have the default judgment vacated. There are two types of New York Affidavit in Support of Motion to Vacate a Default Judgment by Defendant (Civil Cases): an Affidavit in Support of Motion to Vacate Default Judgment for Lack of Personal Jurisdiction, and an Affidavit in Support of Motion to Vacate Judgment for Lack of Notice. The former is used when the defendant was not properly served notice of the lawsuit, while the latter is used when the defendant was not properly notified of the court date. Both affidavits must contain detailed and accurate information about the defendant's circumstances, including why they failed to appear or respond to the complaint.
