Welcome to The United States District Court for the Southern District of New York encompasses the counties of New York, Bronx, Westchester, Rockland, Putnam, Orange, Dutchess, and Sullivan and draws jurors from those counties.

A summons with notice or summons and complaint must be served within 120 days of filing with the County Clerk.

This Stipulation to Extend Time to Respond to Complaint (NY) is a standard form that attorneys can use to extend a defendant's time to file a responsive pleading or motion to dismiss in a civil action in New York Supreme Court on consent without prior permission from the court.

The written response must be made within 20 days of personal service, or within 30 days of the time when service by any other means is complete. If the defendant fails to respond he or she is in default and plaintiff may be able to obtain a default judgment against the defendant.
