A New York Arrest or Charge Affidavit is a sworn statement by a law enforcement officer that officially charges an individual with a criminal offense. This statement is required by the New York criminal justice system in order to move forward with the arrest or prosecution of an individual. The New York Arrest or Charge Affidavit serves as a formal record of the arrest and the charges being brought against the individual. It includes information such as the name of the person arrested, the date and time of the arrest, the location of the arrest, the type of crime alleged, and the officer's statements about the facts of the case. There are three main types of New York Arrest or Charge Affidavits: an Arrest Affidavit, an Information Affidavit, and a Complaint Affidavit. An Arrest Affidavit is used by a law enforcement officer to swear to the facts of a criminal case. An Information Affidavit is used to provide additional information about a criminal case that is not included in the Arrest Affidavit. Finally, a Complaint Affidavit is used to submit a formal complaint against an individual for criminal activity.
