Your case can be heard in Small Claims Court if your claim is for less than $5,000, and your case is based upon one of the following: A written or oral contract or agreement. negligent driving of a motor vehicle. Return of a tenant's security deposit.

Within 30 days after the termination of a tenant's lease the landlord must return the tenant's security deposit plus the tenant's portion of interest, less any allowable fees, by personal delivery, certified or registered mail.

Either party can appeal a decision in small claims court. You should consider whether the amount at stake in your case is worth the cost of filing an appeal.

Small claims handles cases in which the demand is not more than $5,000. These are the monetary limits of small claims. If the amount of money you are trying to recover is more than the monetary limits but less than $20,000, your case should be filed in the regular Special Civil Part.

If the money is not collected (liens) Request to have the judgment recorded as a lien against any real estate the debtor owns. Once the judgment is recorded in the Superior Court, the debtor cannot sell with clear title any real estate owned in New Jersey until the debt is paid.
