Nebraska Juvenile Civil Citation is a diversion program for juvenile delinquents that seeks to avoid the criminal justice system. It is also referred to as “Citation and Release” and is designed to allow juveniles to receive an appropriate response to minor offenses without the formal court process. By participating in the program, eligible juveniles are given an opportunity to repair the harm caused by their behavior and to be held accountable for their actions without a criminal record. There are three types of Nebraska Juvenile Civil Citation: 1) First-Time Offender Cite-and-Release; 2) Alternative to Detention Cite-and-Release; and 3) Repeat Offender Cite-and-Release. The First-Time Offender Cite-and-Release allows eligible juveniles to be cited and released to their parents or guardians, with a requirement to complete certain services or activities. The Alternative to Detention Cite-and-Release is for juveniles who are deemed at risk of not appearing in court or re-offending. This program allows for juveniles to be released from detention and required to complete services or activities as an alternative to detention. The Repeat Offender Cite-and-Release allows eligible juveniles to be issued a citation and referred to a juvenile probation officer for a more structured program of supervision. All three types of Nebraska Juvenile Civil Citation offer juveniles an opportunity to repair the harm caused by their behavior, while avoiding the formal court process.
