This rule requires the court to conduct a hearing to determine if there is sufficient evidence to show that the defendant has violated the terms of his or her probation or supervised release. The waiver form allows the defendant to give up his or her right to a hearing, and to instead allow the court to decide the issue without a hearing. The Voluntary Waiver is signed by the defendant and indicates that the defendant knowingly and voluntarily waives his or her right to a hearing. The Involuntary Waiver is signed by the defendant’s attorney and indicates that the defendant’s attorney has advised the defendant of his or her right to a hearing and that the defendant has chosen to waive the hearing.
