North Carolina Order for Relief from the Automatic Stay-Real Property is a court order issued by the North Carolina Bankruptcy Court. It grants relief from an automatic stay that would otherwise prevent a creditor from taking action to collect an unsecured debt from a debtor’s real property. The order may be issued when a debtor has defaulted on a loan, or when a debtor has filed for bankruptcy. The order allows the creditor to foreclose on the real property, or take other appropriate action to collect the debt. There are two types of North Carolina Order for Relief from the Automatic Stay-Real Property: Order of Relief from Stay and Motion for Relief from Stay. The Order of Relief from Stay is issued when a debtor has defaulted on a loan or when a debtor has filed for bankruptcy. The Motion for Relief from Stay is filed when a debtor has failed to make payments on a loan or has filed for bankruptcy.
