The Michigan Uniform Child Support Order Deviation Addendum effective January 1, 2017, is a legal document that allows parents to deviate from the Michigan Child Support Formula in order to reach a mutually agreeable child support amount. The Michigan Uniform Child Support Order Deviation Addendum allows parents to calculate child support by taking into account their individual circumstances, including income, assets, and parenting time. The addendum also allows the parties to include additional terms regarding health insurance premiums, job-related expenses, extraordinary expenses, and other matters related to the care and support of the children. The Michigan Uniform Child Support Order Deviation Addendum is typically used in cases where the parties have reached an agreement regarding child support but need a legally binding document to memorialize the terms of the agreement. There are two types of Michigan Uniform Child Support Order Deviation Addendum effective January 1, 2017: the “standard” addendum and the “flexible” addendum. The standard addendum is used when parties are able to come to an agreement that is not significantly different from the Michigan Child Support Formula. The flexible addendum is used when the parties have reached an agreement that deviates greatly from the Michigan Child Support Formula. Both types of addendums must be approved by the court in order for them to be legally binding.
