The Massachusetts Personal Representative's Affidavit of Notice to Creditors of Representation of Insolvency is a legal document that is used to notify creditors of the insolvency of a decedent's estate. This document is typically filed in the Probate and Family Court in the county where the decedent was domiciled. The affidavit states that the Personal Representative is giving notice of his/her appointment as representative to the creditors of the insolvent estate and that all creditors are required to present their claims to the estate within a prescribed period of time. It also notifies creditors that the Personal Representative will not be held liable for any debts or liabilities incurred prior to the filing of the affidavit. The Personal Representative is required to sign and swear to the truth of the affidavit before a notary public or justice of the peace. There are two types of Massachusetts Personal Representative's Affidavit of Notice to Creditors of Representation of Insolvency; one for estates in which the decedent was domiciled in Massachusetts and one for estates in which the decedent was domiciled in another state.
