Illinois Summons (Small Claims) is a formal notice from the court, issued by the clerk of the court, to the defendant informing them of a lawsuit that has been filed against them. The Summons must be served on the defendant so that they are aware of the lawsuit and have the opportunity to respond. There are two types of Illinois Summons (Small Claims): a regular summons and a special summons. A regular summons is used when a plaintiff is suing a defendant for a debt or damages. A special summons is used when a plaintiff is seeking an injunction or other equitable relief. The Summons must include the name of the court, the case number, the plaintiff's name and address, the defendant's name and address, and the date and time the defendant must appear in court. The Summons must also be served on the defendant, either by a process server or by certified mail.
