An Illinois Temporary Custody Hearing Order is a court order issued by a judge in the state of Illinois that grants temporary custody of a minor to one of the minor's parents or someone else. The order is usually put in place when one parent has left the home and is no longer able to take care of the child or when there is an immediate need to protect the child from abuse or neglect. There are two types of Illinois Temporary Custody Hearing Orders: Emergency and Plenary. An Emergency Temporary Custody Hearing Order is issued when there is an immediate danger to the minor’s safety and the judge believes that the minor will suffer imminent harm if the order is not issued. A Plenary Temporary Custody Hearing Order is issued after a hearing that takes place between the parents. This type of order can last up to two years, and can be extended by the court.
