Acceptance Of Service

Iowa Acceptance of Service is a form used in the state of Iowa to officially acknowledge that a recipient has been legally served with a court document or other legal papers. It is a way to prove that the recipient has received the papers, and is important for evidence in a court of law. There are two types of Iowa Acceptance of Service: Personal Acceptance of Service and Voluntary Acceptance of Service. Personal Acceptance of Service requires that a court document or legal papers be served to the recipient in person. Voluntary Acceptance of Service is when the recipient voluntarily agrees to accept service of the papers, either in person or by mail.

665.5 Imprisonment. If the contempt consists in an omission to perform an act which is yet in the power of the person to perform, the person may be imprisoned until the person performs it. In that case the act to be performed must be specified in the warrant of the commitment.

442(7)Certificate of service. The certificate shall identify the document served and include the date, manner of service, names and addresses of the persons served. The certificate shall be signed by the person making service. Unless ordered by the court, no other proof of service shall be filed.

The person serving the process shall make proof of service thereof to the court promptly and in any event within the time during which the person served must respond to the process. Failure to make proof of service does not affect the validity of the service.
