The California Declaration Confirming Parentage in Stepparent Adoption — Gestational Surrogacy is a legal document filed to the court to establish legal parentage of a child born through Gestational Surrogacy. It is used to establish parentage for a stepparent adoption, recognizing the intended parent or parents as the legal parents of the child. This document is commonly used in situations where the intended parents are married and one of them is the biological parent, and the other is the stepparent. There are two types of California Declaration Confirming Parentage in Stepparent Adoption — Gestational Surrogacy. The first is a Pre-Birth Order, which is filed prior to the birth of the child and establishes the intended parents as the legal parents of the child before he or she is born. The second is a Post-Birth Order, which is filed after the child is born and is used to establish legal parentage when the intended parents do not qualify for a Pre-Birth Order. Both of these documents must be signed by the intended parents and the gestational surrogate, and witnessed by two individuals.
