The Alabama Petition for Visitation is a legal document used by family members who wish to obtain court-ordered visitation rights with a minor child in the state of Alabama. This document is filed in the Circuit Court of the county where the minor child resides. The Petitioner, who is the family member wishing to obtain visitation rights, must provide the court with specific information regarding the minor child and the relationship between the Petitioner and the minor child. In addition, the Petitioner must provide evidence that visitation would be in the best interests of the minor child. There are three different types of Alabama Petition for Visitation. These are Grandparent Visitation, Non-Parent Visitation, and Stepparent Visitation. Each of these petitions requires different information and evidence to be provided to the court. Depending on the type of petition filed, the court may require the Petitioner to provide evidence of the existing relationship between the Petitioner and the minor child, the Petitioner's ability to provide for the child's welfare, and other relevant information. If the petition is granted, the court will issue an order granting the Petitioner visitation rights with the minor child.
