Alaska Motion to Set Aside Judgment of Forfeiture is a legal procedure that allows a person to challenge a court judgment of forfeiture. This motion is used when someone believes that their property has been wrongfully seized or forfeited by the state and that they are entitled to a return of their property. There are two types of Alaska Motion to Set Aside Judgment of Forfeiture: (1) a motion based on lack of subject jurisdiction; and (2) a motion based on newly discovered evidence. The motion must be filed in the superior court in the district where the judgment of forfeiture was entered. The motion must include a statement of the facts showing why the judgment should be set aside and must be accompanied by an affidavit that sets out the evidence in support of the motion.
