In any given state, EPA or the state's hazardous waste regulatory agency enforces hazardous waste laws. EPA encourages states to assume primary responsibility for implementing a hazardous waste program through state adoption, authorization and implementation of the regulations.
Texas is authorized to administer the Resource Conservation and Recovery Act hazardous waste program under EPA oversight. The Waste Enforcement Branch, with the State, is responsible for enforcing these regulations. The Branch conducts inspections, reviews and data analysis to assess compliance.
EPA has given the Texas Commission on Environmental Quality responsibility for implementing the these regulations in Texas. To do so, TCEQ has established the Texas Pollutant Discharge Elimination System for issuing permits to facilities that discharge effluent to surface waters of the State of Texas.
(a) A transporter of hazardous waste must keep a copy of the manifest signed by the generator, himself, and the next designated transporter or the owner or operator of the designated facility for a period of three years from the date the hazardous waste was accepted by the initial transporter.
