To request a copy of a medical record from a physician, call or write to the physician holding the record. If the physician does not respond to this request within a timely manner, you can file a complaint with the NYS Department of Health, Office of Professional Medical Conduct for Physicians.
If the Crown thinks you can be released, and your lawyer or duty counsel agree with the Crown on the conditions of your release, a “consent release” will be proposed to the court. The judge or justice of the peace will decide if the proposed consent release is acceptable.
What is a Release Form? A release form, or general release form, is a legal document that serves as consent in writing to release the legal liability of a releasee by a releasor. The document is a formal acknowledgment that, once signed, is a legal release of all a releasee obligations within an agreement.

An informed consent document is typically used to provide subjects with the information they need to make a decision to volunteer for a research study. § 2442. Informed consent. No human research may be conducted in this state in the absence of the voluntary informed consent subscribed to in writing by the human subject. If the human subject be a minor, such consent shall be subscribed to in writing by the minor's parent or legal guardian.
New York State Law gives patients and other qualified individuals access to medical records. There are some restrictions on what may be obtained and fees may be charged by physicians, other health care professionals and facilities for providing copies.
Section 18 requires that within 10 days of a written request for access to records, the provider must give the qualified person the opportunity to inspect the records. Providers must also provide copies of records if copies are requested within a reasonable time frame.
