So, here's the rule, as recently summarized by a New York County trial court: "The requirements for formation of an enforceable contract are: (1) at least two parties with legal capacity to contract; (2) mutual assent to the terms of an agreement with reasonably certain terms; and, (3) consideration (i.e., payment).
Offer: A clear proposal to make a deal. Acceptance: A definite agreement to the terms of the offer. Consideration: Something of value exchanged between the parties. Intention to Create Legal Relations: A mutual intention to form a legally binding agreement.
The seven essential elements of a contract are: Offer. Acceptance. Consideration. Legally competent parties. Meeting of the minds. Terms of the contract. Legality of purpose.
The basic elements required for the agreement to be a legally enforceable contract are: mutual assent , expressed by a valid offer and acceptance ; adequate consideration ; capacity ; and legality .
As a requirement of Local Law 196 of 2017, workers at most major construction sites must be able to show that they have completed OSHA 10 training within the previous five years. On December 1, 2019, workers will be required to have 30 hours of training.
Once issued, an OSHA card is valid indefinitely. However there are some exceptions. The states of Connecticut, Pennsylvania and New York require recertification every five years. There is no OSHA 10 or 30 refresher course, so to remain active a new course must be purchased and completed in full.
Card holders will be required to take refresher courses 12 months before the card's expiration date to renew their SST card. Expired Site Safety Training (SST) cards are NOT renewable. Students with expired cards MUST apply for a new card and complete ALL the required NEW SST card training.
New York. New York operates an OSHA-approved State Plan covering only state and local government workers.
OSHA Cards do not expire. Per LL196 these cards need to be refreshed if older than 5 years old, in order to obtain an SST Card. Once a SST Card is issued, you need not refresh the OSHA card again.
