Filing a first trademark application, such as a UK application, for a particular mark, generates a 'priority date'. The priority date of all matter (whether claimed or not) in an application is, prima facie, the date of filing of the application.An applicant may seek to establish a "priority date" for an application in accordance with s. 5 of the Patents Act 1977. The deadline for filing a priority claiming application is: • Patent application 12 months. • Utility model - 12 months. Ordinarily a patent application must be filed within 12 months of the filing date of the earlier application from which priority is claimed.
