Under Georgia law, there are two types of joint ownership. The first, known as “Joint Ownership with Rights of Survivorship” means that two or more parties have simultaneous ownership of a property. When one of those parties dies, their share of the property passes to the surviving owner(s).

The main ways to hold title to real estate in Florida are (1) Tenants in Common (2) Tenants by the Entireties and Joint Tenants with the Right of Survivorship.

The right of survivorship does override any wills that are in place. That's because this kind of arrangement avoids probate. But if the last surviving party in a JTWROS dies, the agreement no longer applies, which means the asset or property is included in their will and goes to their heirs.

A valid right of survivorship always overrides a Will. This is because a property that has a right of survivorship passes automatically to the surviving owner, and legally so. Thus, the property legally cannot be included as a part of the deceased owner's estate.

The spouse who holds the title of the property is responsible for applying for homestead exemption. Whether the house is owned through joint ownership with rights of survivorship, tenancy by the entirety, or another ownership type, Florida law preserves the rights of the owner's spouse.

The other manner of holding the title to property in Georgia is as joint tenants with rights of survivorship. This method is similar to tenancy by the entirety, which is common in many states as the default for married couples purchasing property.
