The U.S. Department of Labor (DOL) administers and enforces most federal employment laws, including those covering wages and hours of work, safety and health standards, employee health and retirement benefits, and federal contracts. Several other federal agencies also administer laws affecting employment issues.
In other words, each workplace is regulated by either Federal OSHA or a state OSH program. Whether your facility is covered by a federal or state program depends on your state. If your state has an approved program, you will respond to your state-level OSH agency, rather than Federal OSHA.
Labor law is a subset of employment law focusing specifically on the interactions between employers, workers, and labor unions. Labor law topics include union membership, union dues, and collective bargaining agreements.
Employment law regulates the relationship between employers and employees. Labor law regulates the additional dimension that arises when employees select (or consider selecting) a labor union to represent them in their dealings with their employer.
If there is an employment dispute, federal law may supersede state law, as every state is legally obligated to follow federal law. However, the FLSA only provides a minimum threshold for employee rights. Most states, including California, have expanded on the minimum requirements.
When it comes to labor laws, states often have more authority to expand the rights of employers or employees. In California, there are several labor laws that expand on the rights of employees already set forth by federal law.
These include right to work of one's choice, right against discrimination, prohibition of child labour, just and humane conditions of work, social security, protection of wages, redress of grievances, right to organize and form trade unions, collective bargaining and participation in management.
