If an employee in California clocks in for work before their scheduled start time with permission from their employer, it generally shouldn't pose an issue. California labor law allows for flexible clock-in practices when authorized by the employer.

In general, when an individual resides in California, they are subject to California's comprehensive and protective labor laws regardless of where their employer is located. California laws also apply to those who are legal residents of other states but are working in California.

Some California wage laws also closely follow federal law. Under federal law, an employer can round down working time lasting seven minutes or less. This can be disappointing, but the California Court of Appeals indicates that employees should at least break even in a rounding system if they work long enough.

Our employment attorneys have found that employers typically round to the nearest 15 minutes or quarter-hour. This allows for the “7 minute rule,” where: the first 7 minutes to the increment, 1 through 7, are rounded down, and. the final 7 minutes, or 8-15, are rounded up.

How does the 7-minute rule work in practice? In practice, if an employee clocks in or out within 7 minutes before or after a quarter-hour mark, the time is rounded to the nearest 15-minute increment. For example, if an employee clocks in at AM, the time may be rounded to AM.

California law allows time-rounding only under very specific conditions—the rounding must be neutral and not undercompensate employees over the long run.
