Notice of Eviction If the tenants do not move out, they will be evicted. The eviction must take place on a business day, during the day. The tenant can ask the court to stop the eviction by making an Order to Show Cause. If this happens, you will have to go back to court to fight this.

Before executing the warrant the sheriff or marshal must give notice in writing to the persons to be evicted. The marshal may perform an eviction or obtain legal possession between a.m. and p.m., Monday through Friday, except on legal holidays.

You may have to wait in the clerk's office or to go to the courtroom where your papers have been sent. The Judge may sign your order to show cause and stop the eviction until the case can be heard. In some situations, the judge may sign the order but not stop the eviction.
